Our client is a dynamic, innovative and fast growth global medical device company. It has created a new position of sole Lead Counsel DACH Region for an experienced fluent German/English speaking medical device/pharma lawyer to support their operations across Germany, Austria and Switzerland. This role will be based in Cologne (Germany), report to the EMEA General Counsel and will be supported by colleagues in the EMEA legal team and external counsels.

 

As the Lead Counsel you will contribute to the company’s success by supporting all aspects of DACH Area operations (particularly sales/marketing and manufacturing) and will advise the commercial and functional leaders broadly on commercial, corporate, regulatory, competition, and compliance issues. This will include the review of marketing and sales programs, contract drafting and review, compliance programs and general legal support and advice.

 

Responsibilities:

• Lead responsibility for all legal support in the DACH Area.

• Provide high quality legal and strategic advice and day-to-day support to the DACH commercial and functional teams.

• Anticipate and address critical legal, business and ethical issues.

• Advise and keep the EMEA GC updated on projects and assist in reviewing all matters relating to compliance and financial reporting as appropriate.

• Work closely with the EMEA GC and other members of the EMEA Legal Department to create, develop, implement and maintain a risk-based compliance program with consistent and effective European policies and procedures, reflective of domestic laws, rules and culture.

• Plan and deliver risk-based training programs including interactions with HCPs, competition law, etc.

• Work closely with the DACH HR Department on employment issues or other issues common to HR and Legal.

• Effectively establish and manage relationships with the DACH Area external Counsels.

• Keep abreast of changes in laws and regulations that may affect the DACH Area.

 

Ideal profile:

• 5+ years post-bar experience, ideally gained within a medical device/pharma or healthcare environment or with a top-tier law firm representing such clients.

• Highly motivated and enthusiastic individual with initiative, adaptability and integrity.

• Excellent communication and diplomatic skills to influence and negotiate with key stakeholders.

• Enjoys working in a challenging, fast paced and dynamic workplace.

• Fluent in spoken and written German and English.

• Experience of working with multicultural teams.

• Confident team player and ability to develop relationships and networks at all levels.

• Proactive in identifying unmet needs/future challenges and proposing strategies to optimize outcomes.

• Strong business acumen and ethical standards with the skills to influence and negotiate with key stakeholders.
